Major Land Use DecisionOn May 7, 2010, the New Hampshire Supreme Court affirmed the approvals by the Plymouth Planning Board and the Plymouth Zoning Board of Adjustment for the commercial development of a 77.46 acre parcel located entirely within the 100 year flood plan between Tenney Mountain Highway, Route 25 and the Baker River in Plymouth, NH. Attorney Raymond D’Amante, representing Lowe’s Home Improvement Centers, obtained the interim and final approvals from the Plymouth Planning Board and Plymouth Zoning Board of Adjustment, prevailed on multiple requests for rehearings and reconsideration at all levels, obtained two favorable decisions by the Grafton County Superior Court affirming those local decisions and an interim appeal to the New Hampshire Supreme Court. The Appellant was a retired Justice of the NH Supreme Court.
